Welcome to Xifaro. These Terms and Conditions ("Terms") govern your use of our German language courses and related services. By accessing our website, enrolling in our courses, or using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Acceptance of Terms

By registering for any course offered by Xifaro, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions. If you do not agree with any part of these Terms, you must not use our services or enroll in our courses.

2. Course Enrollment and Payment

2.1 Registration

To enroll in our German language courses, you must complete the registration process and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Payment Terms

All course fees must be paid in full before the commencement of classes unless otherwise agreed upon in writing. We accept various payment methods as indicated on our website. All prices are listed in the applicable currency and are subject to change without prior notice.

2.3 Refund Policy

Refund requests must be submitted in writing to [email protected]. Refunds are processed according to the following schedule:

• Full refund if cancellation occurs more than 14 days before course start date
• 50% refund if cancellation occurs 7-14 days before course start date
• No refund for cancellations made less than 7 days before course start date
• No refunds after the course has commenced

3. Course Delivery and Attendance

3.1 Class Schedule

Xifaro reserves the right to modify class schedules, instructors, or course content as necessary. We will make reasonable efforts to notify enrolled students of any significant changes in advance. Classes may be conducted online, in-person, or in a hybrid format as specified during enrollment.

3.2 Attendance Requirements

Students are expected to attend all scheduled classes. Regular attendance is crucial for language acquisition and course completion. While we understand that occasional absences may occur, consistent non-attendance may result in removal from the course without refund.

3.3 Make-up Classes

Make-up classes for missed sessions may be available at the instructor's discretion and subject to availability. Students must request make-up sessions within 48 hours of the missed class by contacting us at +1 416 678 4567.

4. Intellectual Property Rights

All course materials, including but not limited to textbooks, worksheets, audio recordings, video content, presentations, and digital resources, are the intellectual property of Xifaro or our licensed partners. Students are granted a limited, non-exclusive, non-transferable license to use these materials solely for personal educational purposes during their enrollment period.

Students may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any course materials without prior written consent from Xifaro.

5. Student Conduct and Responsibilities

Students are expected to maintain professional and respectful behavior toward instructors and fellow students at all times. The following actions are strictly prohibited:

• Harassment, discrimination, or intimidation of any kind
• Disruption of classes or learning environment
• Plagiarism or academic dishonesty
• Unauthorized recording or sharing of class sessions
• Use of course materials for commercial purposes

Violation of these conduct standards may result in immediate removal from the course without refund and potential legal action.

6. Limitation of Liability

Xifaro strives to provide high-quality German language instruction; however, we make no guarantees regarding specific learning outcomes or language proficiency levels. Student progress depends on various factors including individual effort, practice, and aptitude.

To the fullest extent permitted by law, Xifaro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or participation in our courses. Our total liability shall not exceed the amount paid by you for the specific course in question.

7. Privacy and Data Protection

We are committed to protecting your personal information. Our collection, use, and storage of your data are governed by our Privacy Policy, which should be read in conjunction with these Terms. By using our services, you consent to our data practices as described in our Privacy Policy.

8. Course Cancellation by Xifaro

Xifaro reserves the right to cancel any course due to insufficient enrollment, instructor unavailability, or unforeseen circumstances. In such cases, enrolled students will receive a full refund of course fees or the option to transfer to an alternative course of equal value.

9. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services following any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in Toronto, Ontario, except where prohibited by law.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Xifaro regarding your use of our services and supersede all prior agreements and understandings.
